Pre-release software

Nap is in private beta and under active development. Some components may be unstable, change, or stop working.

Pre-release status applies to product functionality, not to our security or privacy commitments.

Licence

Your invitation, order, or subscription gives you a licence to use Nap and install its clients on devices you own or control.

The licence is personal to you and your organisation, and it is not transferable. Under it:

• Do not redistribute, resell, sublicense, or offer the software to third parties as a service, unless a separate written agreement permits it.
• Do not remove or alter licence keys, copyright notices, or attribution.
• Do not circumvent licensing, entitlement, or usage limits.
• Do not present the software, or a modified copy of it, as your own product.

Reverse engineering is permitted to the extent applicable law allows it and does not permit us to exclude it by contract.

Open-source components included in Nap remain covered by their own licences.

Acceptable use

These rules govern what you and the people you invite may do with Nap, including what agents do on your behalf when they reach other systems.

• No illegal use — do not use Nap for activity that violates applicable law.
• No attacking anyone — unauthorised access, scanning, credential stuffing, or denial of service.
• No malware — do not store, distribute, or command malware through Nap. A local model may inspect files for malware and produce an aggregated report.
• Respect other services — follow the rules, rate limits, and bot policies of services your agents use.
• No resource abuse — no mining or other activity that degrades shared infrastructure.
• Respect rights — do not hold or process material you have no right to use.
• The people you add — these rules cover them too, and you are responsible for the access you grant.

Invited users may be represented by endpoint, user, tenant, role, and invite records even when their email address or profile name is not held. Their data is covered by our Privacy notice.

What happens then. We may investigate, limit access, suspend a deployment, or end access when reasonably necessary to stop harm, comply with law, or enforce these terms. Where circumstances allow, we will explain the reason in writing.

Payment

Direct web payments are processed by Stripe. Purchases made through an Apple app are processed by Apple and are also subject to Apple's purchase and subscription-management terms. The price, currency, and billing period shown at the checkout form part of these terms. Prices are shown excluding tax unless the checkout says otherwise, and any tax due is calculated and added there.

Subscriptions renew automatically at the end of each billing period until you cancel.

Prices can change while Nap is in beta. A change applies to new subscriptions. If one ever applies to yours, we tell you before it takes effect and you can cancel instead of paying it.

If a payment fails, we retry it for about three weeks and tell you each time. If it has still not gone through, the subscription ends and your VPS stops. The disk is kept for 30 days after that.

Refunds

• Direct purchases — a full refund is available within 30 calendar days of the initial charge. Email hello@elvin.engineering from the address used for the purchase.
• Apple purchases — Apple's refund process applies because Apple controls that transaction.

Refunds return to the original payment method. If something on a bill looks wrong, send us the receipt and we will review it.

Termination

You can cancel at any time, for any reason or none. Cancelling stops the next renewal. Your VPS runs until the end of the period you have already paid for, and then it stops. That period is not refunded on its own, though the 30-day refund window above still applies if you are inside it.

Subscriptions bought through an Apple app are cancelled in Apple's settings, not here.

We can end it if you break Acceptable use, or if a payment goes unpaid.

Your data is yours. Nap keeps your content on your own devices first, so in the normal case a copy is already with you — cancelling takes away the VPS, not your files. What lives only on the VPS is what the VPS produced: schedules, agent state, and the like. There is no export tool for it today. Until there is, ask us within the 30 days the disk is kept and we will get you what is there.

Liability

Nap is provided as it is. We do not promise it will suit a particular purpose or run without fault.

If we owe you something, the most we can owe in total is what you paid us in the 12 months before the event that caused the claim. We are not liable for lost profit or lost business.

Your agents and automations act on your instructions, on your devices and on the internet. If someone brings a claim against us because of what you did with Nap, including what your agents reached, what you stored, or a right you did not have, you cover our reasonable costs of dealing with it, including legal fees. This does not apply where our own breach of these terms caused the claim.

None of this removes rights the law gives you and does not let us take away. If you are a consumer where you live, those rights stand.

Changes

We update these terms as Nap changes. Small corrections, such as a clearer sentence or a fixed link, go up with a new date at the top of this page.

For a change that materially affects you, we tell you at least 30 days before it takes effect by email or in the product. You may stop using the service before the change takes effect.

These terms are governed by the law of the State of Wyoming, where EE Works LLCis registered. If you are a consumer, that does not take away the protections of the law where you live.
